Request for nationality for children of Chilean citizens born overseas

Article 10, Nº 3, Political Constitution of the Republic of Chile, modified by Law Nº 20.050, August 26, 2005, promulgated a series of constitutional reforms on nationality matters.

Article 10, Nº3, was modified, eliminating the requirement of settlement in the country for more than a year, regarding the children born overseas to a Chilean father or mother.

However, this reform adds a new requirement stipulating that the children born overseas to a Chilean father or mother will have to prove that one of their parents or grandparents had been granted the Chilean nationality:

  • Due to birth in national territory;
  • Naturalization Letter or
  • Honorary naturalization

The registration of the children born overseas to Chilean citizens, may be performed before the respective Chilean Consulate, if overseas, or before the Civil Registry and Identification Service, if in Chile.

Who is it addressed to?

To children born to Chilean citizens overseas.

Requirements

  • To accredit that one of the parents or one of the grandparents is a Chilean national
  • To submit a document of identity as a proof of the nationality of the relatives

Request for the recovery of nationality for Chilean citizens overseas

What does it consist in?

Those Chilean citizens who under any circumstance, had been granted another nationality in a foreign country and had renounced the Chilean nationality in writing and voluntarily.

In this case, the Chilean citizen must appear at the Consulate and fill in a form designated "Solicitud de Anotación de Perdida de Nacionalidad" ("Loss of Nationality Registration Request Form"). This form is sent to the Civil Registry and Identification Service in Chile in order to eliminate the record of the loss of nationality, and afterwards the applicant will be informed about its new situation.

Who is it addressed to?

To Chilean citizens who have renounced the Chilean nationality in writing.

To provide proof of the Chilean nationality.

Recovery of the Chilean nationality.

Observations

  • Additional records may be requested during the application procedures.
  • In the case of those Chilean citizens naturalized overseas who did not renounce the Chilean nationality voluntarily and in writing, it will be considered that they have never ceased to be Chilean.
  • Those Chilean citizens who apply for the procedure of recovery of nationality, must take into account the regulations of the country where they are residing, for there are some countries in which holding two nationalities is forbidden by law.
